Acceptable Use Policy

1. Purpose

Foundworks ("the Service") is an AI-driven business operating system that runs autonomous agents on your behalf. This Acceptable Use Policy ("AUP") defines what you may and may not do with the Service. It supplements — and is incorporated by reference into — our Terms of Service. By using Foundworks you accept this AUP. Violations may result in tool revocation, account suspension, or termination as described in Section 7.

2. Prohibited content and conduct

You may not use Foundworks — directly or via agents you instruct — to create, store, transmit, or facilitate:

  • Activity illegal in your jurisdiction or in any jurisdiction where the Service operates
  • Harassment, threats, doxxing, hate speech, or content targeting individuals or protected groups
  • Child sexual abuse material, non-consensual intimate imagery, or content that exploits minors in any way
  • Malware, exploit code, credential stuffing, phishing kits, or unauthorized access to computer systems
  • Infringement of copyright, trademark, trade secret, or other intellectual-property rights
  • Processing of personal data of identifiable individuals without a lawful basis under GDPR or equivalent privacy law
  • Fraud, scams, deceptive practices, or impersonation of any individual, business, or government entity
  • Disinformation campaigns, election interference, or coordinated inauthentic behavior
  • Glorification or incitement of violence, self-harm, or terrorism

3. Restricted industries

The following activities require prior written consent from Foundworks before you enable them on your account. Email us at [email protected]:

  • Cryptocurrency token sales, ICOs, airdrops, NFT promotion, "pump" campaigns
  • Online gambling, sports betting, lotteries
  • Adult content and services
  • Pharmaceuticals, prescription drugs, controlled substances, nicotine, vaping, cannabis
  • Firearms, ammunition, explosives, weapons of any kind
  • Multi-level marketing and pyramid schemes
  • Regulated financial advice without applicable license (investment advice, lending, insurance, FX trading)
  • "Get rich quick" or "make money fast" programs

4. Agent-driven email (the send_email tool)

When you connect your Outlook account, Foundworks agents can draft and — with your approval — send email as you, from your own address. You are the legal sender of every message your agent transmits. When you use send_email you specifically agree:

  • No unsolicited bulk email. You must have a prior business relationship with each recipient, or have collected their explicit opt-in consent, before any agent contacts them.
  • No scraped, purchased, or rented recipient lists.
  • No impersonation of other individuals, businesses, or domains.
  • Compliance with all applicable email law is your responsibility — GDPR / ePrivacy Directive (EU), CAN-SPAM Act (US), CASL (Canada), and equivalent regulations elsewhere.
  • Honor unsubscribe requests promptly (within 10 business days at the latest).
  • Do not auto-approve send_email without first understanding what your agent will send. Auto-approval rules are a power tool; mis-configuration is your liability.

Foundworks may rate-limit, disable, or revoke your send_email access — for your account specifically or platform-wide — without prior notice if abuse is suspected or reported.

5. Platform integrity

You may not:

  • Bypass, interfere with, or attempt to circumvent rate limits, budget caps, approval gates, or other technical controls
  • Reverse engineer the agent orchestration, extract system prompts, or attempt to identify the underlying models
  • Use Foundworks outputs to train, fine-tune, or evaluate competing AI systems
  • Resell, sublicense, or share access to your Foundworks account
  • Generate excessive load designed to disrupt the Service or degrade performance for other users
  • Probe, scan, or test the vulnerability of the Service without prior written authorization

6. Compliance with upstream providers

Foundworks is built on third-party platforms including (without limitation) Anthropic, Azure OpenAI, Microsoft Graph, Mollie, Cloudflare, Sprites, and Microsoft Azure. Their respective acceptable-use and content policies apply transitively to your use of Foundworks. Anything those providers prohibit, Foundworks prohibits — even if not explicitly listed above. Where this AUP and an upstream provider's policy conflict, the stricter rule applies.

7. Enforcement

We may, at our sole discretion and without prior notice, take any of the following actions proportionate to the severity and pattern of the violation:

  • Issue a written warning
  • Disable specific tools (e.g. revoke send_email access)
  • Suspend your account temporarily
  • Terminate your account permanently with no refund of any prepaid subscription
  • Report unlawful activity to applicable authorities and cooperate with law enforcement
  • Preserve evidence relating to the violation as required by law

Severe violations — child safety, fraud, malware distribution — result in immediate termination without warning.

8. Reporting abuse

If you observe abuse of the Service or believe a message sent via Foundworks violates this AUP, please report it to [email protected]. Include the message headers if you have them, and any other context that helps us investigate. We aim to acknowledge reports within two business days.

9. Changes

We may update this AUP from time to time as our service, threat landscape, or applicable law evolves. Material changes will be announced via email to registered users. Continued use of the Service after changes take effect constitutes acceptance of the updated AUP.
